Can I trademark a business name in North Carolina?

Yes. You can register your business name as a federal trademark with the USPTO if you use it in interstate commerce. Note that registering a business name with the NC Secretary of State does not give you trademark rights — federal registration provides much broader protection and is recommended for any business with growth ambitions.

How long does a trademark last?

A federal trademark registration lasts 10 years and can be renewed indefinitely as long as the mark remains in use. Between the 5th and 6th year after registration, you must file a Section 8 Declaration of Continued Use to keep your registration active.

What is the difference between ® and ™?

The ® symbol may only be used once your trademark is officially registered with the USPTO. The ™ symbol can be used at any time — even before filing — to assert your common law trademark rights. Using ® without registration is illegal and can result in the denial of your application.
